Why Do Some Say This Is Legal While Others Claim It Is Illegal?

 

The legality of creating and using a new credit file is based on the fact of privacy rights surrounding the use of Social Security Numbers for identification. The “1974 Privacy Act” states: IT SHALL BE UNLAWFUL... TO DENY ANY INDIVIDUAL ANY RIGHT, BENEFIT, OR PRIVILEGE PROVIDED BY LAW BE­CAUSE OF SUCH INDIVIDUALS REFUSAL TO DISCLOSE HIS OR HER SOCIAL SECURITY ACCOUNT NUMBER. As far as the legality of using an E.I.N. (Employer Identification Number) in place of an S.S.N. (Social Security Number) to serve as a T.I.N. (Taxpayer Identification Number), we could find no reference in any of our United States Federal Laws to this question. This we presume is because both E.I.N.’s and S.S.N.’s are both currently being used and referred to as T.I.N.’s. Remember: It’s estimated that the largest credit bureau in America has over 300 million credit reports on file. If there are only 175 million adults in America, where did the other 125 million credit reports have to come from? (See Section One). The big fact is that none of our research (which continues to this day) has found any case where a creditor has suffered monetary loss due to a consumer creating a second credit file. Furthermore, we are unable to find ANY CASE where a consumer has been penalized for creating a second credit file. Again, second credit files happen more often by accident than by intent!

 The big consumer secret is to never blatantly lie on a credit application. Lying on a credit application is illegal under the “Truth in Lending Act”. However, if a consumer fills out a credit application providing all new and truthful identifying information (i.e. address and phone number etc.) and chooses to use a 9 digit T.I.N. in place of his S.S.N. for privacy reasons (and makes it known by drawing a line through the S.S.N.) and a new credit file is created, he has not lied on any application and therefore violated the truth in lending act. Like wise, if a consumer is issued a new Social Security Number and fills out a credit application with new and truthful identifying information (i.e. address and phone number etc.) and a new credit file is created, he has not lied, either. The application asked for a S.S.N. and he gave them one (even though it was his new one). Morally, we think any anyone would find it sickening how U.S. Banks can run up millions of dollars in debt they are unable to repay and the Government will bail them out. Meanwhile they turn around and make consumers pay for it by raising interest rates. But when a consumer gets in over their head the Government won’t bail them out! Instead, credit bureaus (private entities) get to ruin that individual's life for up to 10 years.

Does A Consumer Really Need To Establish A New Phone Number And Mailing Address?

 

Yes. Remember, credit bureaus keep track of credit files through various pieces of identifying informa­tion. In order to create a new file one must use new identifying information (See Section Two). This is very simple with the help of a friend or private mail receiving firm, which will offer to rent you a street address, as well as your own private voice mail number. If you shop around for these services you will find they are quite modest in price. However, do NOT use Mail Boxes Etc! Use a small “Mom & Pop” outfit. National chains like Mail Boxes Etc. report to credit bureaus as mail receiving firms. Most consumers will just opt to use a friend's address for free.

Why Should A Consumer Start A Home Based Business To Get Their E.I.N..?

 

There are many beneficial reasons for this, although you can get your E.I.N. without starting a business, it makes more sense to obtain it this way. For example: any good accountant will tell you that the person who gets hurt the most by taxes and inflation is the average working person, who is single with no kids, no mortgage, no investments and no business. The person in this country who has the most tax breaks is the one who is married with kids, has a mortgage, investments, and a home based business. Having a home based business, whether it is part time or full time can give you tremendous tax advantages while you are working at your job. Ask an accountant for details on this. It’s not nearly as complicated and “scary” as most consumers think, if you don’t, you are only throwing money away on excessive taxes.

Can A Consumer Add Their Spouse To Their New Credit File?

 

Yes, although this is a big mistake for a variety of reasons. First of all, you want to avoid adding any type of old identifying information to your new credit file. Secondly, adding a spouse to your new credit file makes absolutely no sense whatsoever. The reason is simple: (Two excellent credit reports are always better than one.) When you add your spouse to your credit file, (such as when you get married), both your files then become merged into one. Any good marks on your credit record will have to be shared with your spouse; therefore, you will not be given full credit for them since there are two people on the report. It is almost as if the validity of the credit report is watered down. Worse yet, if either party is late paying or lets an account go to collection, both parties get penalized and are given bad credit. For example: (A single man with no credit could marry a woman who has triple A-1 credit and their files would become merged. If the man defaults on any accounts he will end up costing the woman her good credit, since both their credit files are essentially treated as one.) Adding anyone to your credit profile is a big mistake unless, it is for the mere sake of helping a person expedite their credit building process in which the guidelines for “Piggybacking” a credit file should be followed (See Section Nine).

Can A Consumer Create A New Credit File With A Second Social Security Number?

 

Yes and no. If you make up a second Social Security Number and use it to apply for credit that would be illegal. However, there is no law that we know of that states, if you are legally issued a second Social Security Number you may not use it to apply for credit with all new identifying information. Nor, have we ever heard, that if when applying for credit you must make it known that it is indeed a second Social Security Number you are applying with. Many attorneys feel that if you are issued a second Social Security Number by the Social Security Administration it is NOT illegal to use this number in applying for credit or for other identification purposes. Many attorneys justify this by the fact many illegal immigrants are presently using “self made” Social Security Numbers. After they obtain legal status the Social Security Administration will still issue them a number without ever questioning the legality of the previous fake or fraudulent number they were using. As if this isn’t enough, the Social Security Administration goes out of its way to help legalized immigrants descramble their past Social Security contributions under their old fake or fraudulent numbers and tries to credit them back, so they can be paid under their newly acquired legal Social Security Number.

Does “Piggybacking” Credit Files Really Work?

 

YES! Absolutely. This is one of the most amazing methods we’ve seen! If it didn’t work you wouldn’t see spouses with merged credit files showing both positive and negative information. The key to remember is to only apply as a co-applicant on applications which ask for a Taxpayer Identification Number (a.k.a. S.S.N.), mailing address and phone number etc. A piece of advice when selecting your guarantor or co-signer is that you must be sure they don’t default on any accounts, as they will ruin your credit. (See Section Nine).

What About Employers or Car Dealers That Demand To See A Social Security Card?

 

Employers and Car Dealers etc. may request your Social Security Number, much like any other agency which requests it as a piece of identification, however, to our knowledge they can NOT see or photocopy your card if you object to it for religious or privacy reasons. You may wish to obtain form 1-9 from the IRS. This form outlines requirements employers must follow when hiring. After reading the 1-9 form you will discover that you may use your birth certificate in substitute for your Social Security Card. As for car dealers and car salesman, we have never heard of them asking for the card.

How Do The Credit Bureaus Make Money?

 

Credit bureaus are in the information business and make millions of dollars by renting their information to banks and other organizations. The renting of consumer data is big business in this country. All the junk mail you receive in your mail box each day will attest to this fact. Credit bureaus make their money primarily two ways: 1) By collecting information from your creditors on a monthly basis and keeping your credit profile current, credit bureaus then charge banks, landlords, hospitals, and even employers to receive a copy of your credit report so they can make an informed decision as to whether or not to extend you credit. Remem­ber, creditors in any form are looking for a SOLID financial risk, and credit reports help them make a well informed and calculated decision based on current and sound financial data regarding your repayment habits from the past. And, 2) Credit bureaus make the majority of their income by renting lists of consumers in their databases to large banks and other lending institutions. The banks and lending institutions use these lists to mail their credit card and loan offers to. On the surface it may seem like there’s not much money to be made just in renting someone's name, but let me assure you that when a credit bureau rents out a list of 10 million people with perfect credit at a rate of only .25 cents a name, this works out to 2.5 MILLION in gross revenue! Multiply this figure times just 20 rentals a year and you’re talking about 50 MILLION dollars a year!

This Really Seems Like A Lot Of Work. Isn’t There An Easier Way?

 

First of all, let’s define “A lot of work.” The real question here is: a lot of work compared to what? The alternative to this program is to either spend hundreds of hours performing credit repair techniques to try and clean your file (which may never be able to make it perfect) or, wait up to 10 years for the negative items to elapse and drop from your file. This program may seem like a lot of work because we as human beings have become quite lazy. However, in all actuality, it is very simple. The program can be summed up into five parts: 1) Start your business name and establish new identifying information. 2) Obtain your new Taxpayer Identification Number with form SS-4. 3) Understand how to keep your old credit file from contaminating your new one. 4) Get your new file “ONLINE” with the major credit reporting bureaus by applying for credit. 5) Obtain a secured or consumer credit card with your new credit file. That’s basically it, in a nutshell. Everything worthwhile in life will require some degree of effort, even though the degree of effort may only be slight. When taking into consideration what one can benefit from this program, the amount of “work” required becomes totally insignificant and ridiculous.

What If an E.I.N. Starts With the First Three Digits 582 and You Live In Georgia Where S.S.N.'s Start with 252”. Will This E.I.N. Work?

 

It doesn’t matter what the first 3 digits of your E.I.N. are as long as they fall within the realm of a state issued S.S.N. (See Section Six). For example, S.S.N.'s in the state of Georgia fall within the sequence of "252" to "260". And S.S.N.'s in Puerto Rico and the Virgin Islands fall within the sequence of "580" to "584" or "596". Thus, your E.I.N. will work fine if you choose to use it. Remember, any given state is going to have people living in it that all have different starting S.S.N.’s because of where they were born or where their S.S.N. was originally issued to them. If you really want to get technical it is possible to get an E.I.N. in which the first 3 digits look IDENTICAL to that of an S.S.N. issued from certain states. This can ONLY be done if your current S.S.N. was issued by any one of the following seven states: Massachusetts, Connecticut, New York, Illinois, Wisconsin, California or Texas.

If a Consumer Is Issued an Unusable E.I.N. (one that does not fall within the realm of S.S.N.'s) how do they go About Getting A USABLE E.I.N.?

 

We’ve only heard of this scenario happening ONCE. To remedy the situation as quickly as possible one would need to do the following: 1) Get a mailing address in any one of the states that can issue the proper T.I.N. This can be done by simply going to a local library and finding a phone book there which will have mail receiving firms out of state. Since this address will NOT be used on a credit file it may be a Mail Boxes Etc address. Many times you can get this address right over the phone in a manner of minutes if one pays for the box rental with a credit card. 2) Then the consumer would need to apply for a new T.I.N. to the service center in this state. The only way to get a new T.I.N. is when the form of a business structure changes. For example, if a consumer obtained a T.I.N. for a sole proprietorship and then decided to change it to a partnership, they would have to apply for a new T.I.N.. If one was in a hurry this new T.I.N. could be issued right over the phone. Once the consumer gets a new T.I.N. then they could proceed as usual.

This is likely to be the case about 1 out of a 100 times. This is because it is believed that the SSA recycles old S.S.N.'s and uses them as E.I.N.'s in the future. They will usually rest the number for about 15 years before allowing it to be re-issued. What can happen 1% of the time is that a consumer will be issued a T.I.N. that is a dead persons S.S.N. (The number has been recycled). The number then comes up as deceased since the credit bureaus maintain public death records to keep consumers from using deceased peoples S.S.N.'s to apply for credit (such as a son or daughter using their dead mother or fathers number to gain credit worthiness. YES! It does happen all the time!). To remedy the situation all one has to do is follow Step 2 in the answer to the question posted above. Again, this only happens about 1% of the time but is by no means failure...
